The law ensures the rights of the children with disabilities, as well those of the parents. Not only does the law ensure that children with disabilities have the opportunity receive Free and Appropriate Public Education FAPE, but also in the LRE, Least Restrictive Environment. The law also ensures that parents are fully informed of their rights and are participating in the educational process.

The procedural handbook provided to parents explains their rights and safeguards. This information is to be provided to the parents at least once a year, as well as upon initial referral.

The LRE

Max exposure to non-disabled (typical) peers. “To the maximum extent appropriate, children with disabilities, including children in public or private institutions or other care facilities, are educated with children who are not disabled, and special classes, separate schooling, or other removal of children with disabilities from the regular educational environment occurs only when the nature or severity of the disability of a child is such that education in regular classes with the use of supplementary aids and services cannot be achieved satisfactorily.”
